Judge for yourself – Aston-cum-Aughton – more on dirty tricks!

The full truth will out about this very low and grubby dirty trick by cowardly unnamed Holderness Labour members.

Firstly I am indebted to the local contact for providing me with the following scans of the Aston-cum-Aughton Independents, a sub-group of the Rotherham Independents, I should point out nails one of the most blatant lies in the offending and offensive election literature put out by Labour Party Members!

They really should take a lot more care with the facts, when making claims. Even Phil Woolas, with the benefit of Gerald Shamash as his legal adviser, had eventually to accept that lies on election materials can get you in a lot of hot water indeed! We will hear more on someone called Gerald later.

There are others that will be addressed in a future posting, when I am furnished with scans of similar election material from Labour.

Undoubtedly the best, most open and honest political appeal I have ever seen! No wonder the local Labour Party is worried? They should be!

News from the Courts 2 – Woolas Defeated in Legal Bid! Why was John Healey there?

The second case to move forward this week concerned the Ex Shadow Immigration Minister and former Labour MP, Phil Woolas.

Phil Woolas stooped  very low in his tactics in the Oldham East and Saddleworth and was judged to have made false statements about his Lib Dem opponent, Elwyn Watkins, by an elections court. Woolas was then unceremoniously dumped on further by Harriet Harman the Labour Deputy Leader much to the chagrin of many in the commons on the Labour benches.

On Friday, the high court rejected Woolas’s attempt to contest the finding of the election court, which ruled that he should no longer sit as the MP for the Lancashire constituency and be barred from parliament for three years.

Woolas has now accepted defeat and a by-election will be held in the Oldham East and Saddleworth constituency on February 3rd, the writ being moved as soon as they get back from their Christmas holidays.

The public do not support Woolas but many of his fellow parliamentarians do!

One has to question the wisdom therefore of John Healey, the now Shadow Minister for Health and the MP for Wentworth and Dearne constituency, providing visible support by dignifying proceedings with his presence?

A political mistake I am sure! It remains to be established, who on earth told him to go? and why did he agree?

Woolas – New Parliamentary Statement!

Press statement that has just been released from the Commons authorities:

“After the decision by the election court concerning Phil Woolas, the member for Oldham East and Saddleworth, the Speaker of the House of Commons reported the court’s decision to the House in a statement on Monday. A candidate reported by an election court as personally guilty of an illegal practice is required to vacate their seat in the House of Commons as from the date of the court’s decision (Friday 5 November). “As the seat is now vacant, a by-election will be held once the House of Commons has passed a motion for the issue of a writ.

“The Speaker can neither initiate nor block the motion to move a writ for a by-election. He has no say in when a member moves a writ for the by-election. This is usually done by a member of the party which has previously held the seat. Once the House agrees to a motion for the issue of a writ, the Speaker is required to carry out the House’s decision and to issue his warrant for the by-election. He has no discretion about this. A by-election must be held within 19 working days of the issue of the writ.”

It would appear I was right in a previous posting when I cast doubt on whether there were any potentially successful legal routes open to Phil Woolas.

This appears to confirm it. Lets see who moves the writ first?

Potential replacement Labour Candidates are reportedly already active in the Oldham East & Saddleworth Constituency, circling like vultures already, it would seem?

Labour Mutiny Over Woolas. MPs Turn on Harman at PLP!

Labour Mutiny Over Woolas. MPs Turn on Harman at PLP!

Reports of last nights Parliamentary Labour Party describe it as ‘mutinous’ after MPs launched vitriolic attacks directed at Harriet Harman, Labour’s Deputy Leader.

Harriet Harman on BBC's Andrew Marr Show

Parliamentary Labour Members are furious at Harman for her statement that it was, “not part of Labour’s politics for somebody to be telling lies to get themselves elected”.

When calling for her to resign, I am forced to conclude that they were perfectly happy for lies to be deployed come election time! Are they on a parallel universe? Do they believe that the laws that they make don’t apply to them?

Labour MPs still don’t understand the gulf of trust opening up between them and the electorate. They are acting in the most arrogant of fashions. A little humility would be most appreciated at this time. I note none of these cowardly, disgraceful and arrogant Members has gone on the record! That speaks volumes in itself. Reports indicate that George Howarth, Stephen McCabe and David Watts were among them however. No surprise there then! Denis MacShane was absent as he is currently suspended but Kevin Barron apparently put up a bit of a defence of Harriet, well done on this occasion Kevin! Nothing yet on Wentworth & Dearne MP, John Healey’s views on the matter.

Harriet Harman spoke for all of us, when she repudiated what Woolas had been proved to have done. She should be congratulated, not denigrated by members of her own side! Shame on them!

Jack Dromey

Jack Dromey, the MP for Birmingham Erdington and Harriet Harman’s husband, said on the BBC’s Daily Politics show today,

“I think Ed Miliband and Harriet have done absolutely the right thing, It is no part of our politics to tell lies, to fan prejudice to win votes. What happened was wrong.”

“I’ve always believed in what I’ve called standing on the moral high ground. How we conduct ourselves is of the highest importance.”

.

Jack Dromey is obviously more plugged in to public sentiment that most of his colleagues who simply do not understand how bad it looks to the public, according to a YouGov poll published today. The people have little sympathy for Woolas. Only 7% in fact, with 71% agreeing with the courts decision!

It is also becoming apparent that the legal position is, to say the least, complicated! There may be no judicial avenues open to him after all, which will make yesterdays Speakers ruling that, as far as Parliament was concerned, the matter was Sub Judice look ill-advised and perhaps premature.

The Speaker’s wife’s recent twittering might also not be particularly helpful either. There are no real precedents to this Constitutionally difficult situation and I would have thought it might have been better for her to have refrained from her tweets.

Another One Bites The Dust!

In a move not seen for 99 years, Phil Woolas, Shadow Cabinet member has been stripped of his election victory by two High Court Judges convened as an Elections Court. Mr Justice Nigel Teare and Mr Justice Griffith Williams found Mr Woolas guilty of illegal practices under election law. Read full Judgement here.

The luckless Woolas had the rug pulled from underneath him by Harriet Harman, Labour’s Deputy Leader, when she sought the nearest camera to launch this broadside which appears to have left Woolas with little room for manoeuvre, despite his brave words and his prepared statement read for him by Gerald Shamash.

.

One of Phil Woolas's disgraceful leaflets.

.

It has emerged that the Labour Party Insurers have been paying Woolas’s legal costs, Gerald Shamash, The Official Labour Party Solicitor, does not come cheap. This arrangement is believed to be at an end leaving Woolas high and dry!

Astonishingly this disgraced Labour Shadow Minister has launched a financial appeal that he hopes will collect £200,000! so that he can prove his innocence. Some hope, just who is stupid enough to donate their own money to this farcical enterprise?

We will see tomorrow whether the Speaker understands what he must do, order a by-election as soon as practically possible.

No prevarication, no waiting for Woolas to progress his legal appeals. The findings as to fact will not change no matter what legal stunts Woolas pulls.

The people of Oldham East and Saddleworth deserve nothing less!

The only thing that sticks in my craw was the sight of Simon Hughes, Liberal Deputy Leader, crowing about the victory. I can remember a certain by-election in Bermondsey in 1983, Labour candidate Peter Tatchell lost to Simon Hughes the then Liberal candidate, after the most disgraceful campaign by the Liberals. Pity Peter Tatchell did not see fit to mount a legal challenge back then. Maybe Simon Hughes would now be nothing more than a footnote to history had he done so!

Still got a copy of Peter Tatchell’s book, The Battle For Bermondsey somewhere. It is well worth a read if you are interested in political dirty tricks.

STOP PRESS: 8th November 2010, Judicial review rejected. Speaker announces that an expedited application was now in play.
